Terms & Conditions


The following information represents the contractual conditions between the customer and Parawave for the purchase and use of offered products or services.

If the customer does not agree with these conditions, he does not have the right to purchase, install or use any of the offered products or services.

Delivery of digital products

All of our products are delivered via Internet Download. Once the order and payment has been processed all ordered products will be available to download by visiting the Purchased Products page.

Refund of digital products

Because our products are digital goods delivered via Internet Download we generally offer no refunds.

Please note that we do not bear any responsibility and therefore we do not satisfy any refund/return requests based on incompatibility of our products with some third-party software. Although we generally make sure our products works with a wide number of available DAWs, we do not guarantee that our products are fully compatible with any third-party programs and we do not provide support for third-party applications.

The customer may at any time cancel their order before payment has been processed. We reserve the right to refuse any refund requests.

VAT Notice

We are required by law to display final prices (equal to the product price plus any applicable VAT rate) in the order process. If the country of delivery is changed during the order process, the VAT rate shown may also change.

VAT is applied based on the customers residence. The customer is obliged to provide a correct payment address. If VAT is not applied the customer may have an obligation to remit use tax or similar tax.


Grants

When the customer rightfully purchases a digital product, we grant a worldwide, non-exclusive, non-transferrable right to install the product.The customer is allowed to install and use the product on any computer or device that is and remains in his private possession.

Restrictions

The customer is not allowed to share, sell, rent, lease, transfer, license, outsource or otherwise distribute the purchased product or any part thereof or make the product available to any third party.

The customer is not allowed to install or use the product on any third party computer or device that is not in his private possesion.

The customer shall undertake any necessary steps to protect his product and account against unauthorized use.

Modifications of digital products

The customer is not allowed to alter, merge, modify, adapt or translate the product, or reverse engineer, decompile, disassemble, or otherwise reduce the product to a human-perceivable form.

The customer is not allowed to modify any mechanics or digital right managments of the product, or services it connects to.

Copyright

We retains all rights, title and interest in and to the products and all copies thereof, including copyrights, trademarks and other intellectual property rights. All rights not specifically granted in these conditions, including international copyrights, are reserved by us.

Limited Warranty & Limitation of Liability

THE PRODUCTS ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. YOUR USE OF THE PRODUCTS IS AT YOUR SOLE RISK. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE PRODUCTS OR THE USE OR OTHER DEALINGS WITH THE PRODUCTS.

We cannot guarantee that the products will work at all times. If the customer changes his operating system, or DAW, the products may not work anymore.

We reserve the right to modify, suspend or discontinue, temporarily or permanently, the purchased products or any services to which they connect, with or without notice and without liability to the customer.

Governing Law

These terms and conditions are subject to the law of the Federal Republic of Germany. Venue for the settlement of disputes is the court having jurisdiction over the defendant.
